Definitions

Buyer means the individual or organisation that buys or agrees to buy the Goods from the Seller.

Consumer shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977.

Contract means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions.

Goods means the articles that the Buyer agrees to buy from the Seller.

Website means archieandme.com

 Seller means Archie & Me, Jelmac House, Suite 4, 269 High Street, Berkhamsted, Hertfordshire. HP4 1AA, that owns and operates archieandme.com

. Terms and Conditions means the terms and conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the Seller.

Conditions

Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.

These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.

Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller. Any complaints should be addressed to the Seller’s address at Archie & Me, Jelmac House, Suite 4, 269 High Street, Berkhamsted, Hertfordshire. HP4 1AA.

Delivery

Your order will require a signature on delivery. Orders placed by 11am (Monday to Friday, excluding Public Holidays) will normally be despatched the same day and should be delivered within the mainland UK on the next working day. The cost of delivery will be added to your order total before payment is taken. Our standard delivery charge for delivery to addresses within the mainland UK is £4.95 per order. Should a higher charge apply to a particularly heavy or bulky item, we will advise you prior to processing your order that a higher charge applies. Overseas delivery charges will be quoted and charged on a case by case basis. Dispatch may be slightly delayed for overseas deliveries so please allow up to 30 days.
If an item is out of stock, this will be indicated on the Website whenever possible. Delivery times are estimates only. If we are unable to perform the whole or part of the order due to any cause or event beyond our control we may by notice in writing to you cancel or suspend the order in whole or in part without liability. We may deliver separately the Goods which make up your order. Where we do so, you will only incur one delivery charge. Title to the Goods shall pass to you on payment in full of the price of the Goods.

Cancelations, Returns or Refunds

Customers in the European Union: You may cancel your order up to fourteen days from the day on which you receive the Goods. If you wish to cancel your order, you will have to return any items within seven days of when you tell us that you would like to do so and at your own cost for return or exchange as required. Please obtain proof of posting as we cannot be held responsible for packages lost on return to us. All goods returned to us must be unused, in their original packaging and in resaleable condition. Should you fail to return such goods to us, we may arrange for their return to us and we will charge you any reasonable expenses incurred in our doing so. If you have ordered any service from us you have seven working days after the day that you place your order in which to cancel. However your right to cancel any service ends when our performance of the service starts even if that is within your cancellation period. In the case of cancelled orders, payments will be refunded within thirty days. Alternatively, should any goods be unsuitable, we are happy to exchange them or to offer store credit. Should you wish to return any goods for exchange, refund or store credit, you must email us in the first instance, orders@archieandme.com. We regret that orders for Goods made to your specifications and gift wrapping will not attract any right to cancel. All goods should be returned to the following address: -

Please ensure that all goods returned are suitably packed. We recommend that you insure any goods that are returned to us as we will not be liable for any damage or loss during transit. Please ensure that any goods returned are accompanied by your receipt.
If you return your order in full for a refund, we will refund the original shipping charge to you. Should you return part of your order for refund, we will not refund the original shipping charge. If you return part or the entire order for exchange, we will not refund the original shipping charge however we will ship the replacement goods to you without additional charge.
Please note that, if you return goods that were ordered by another person, any refund due will be made to the person who placed the order. 
Customers outside the European Union: You may return to us any goods that you have ordered for exchange or refund within fourteen days of the day on which you receive the Goods. If you wish to do so, you will have to return any items at your own cost. We will be unable to refund the original shipping cost that was charged to you when you placed your order (unless you are returning the order in its entirety and all the goods ordered were faulty or not as ordered in which case we will refund the original shipping charge). In addition, we will charge you a further amount that will be advised to you if you ask us to ship goods to you as an exchange unless the goods that were originally supplied to you were faulty or not as ordered. Please obtain proof of posting as we cannot be held responsible for packages lost on return to us. All goods returned to us must be unused, in their original packaging and in resaleable condition. If you have ordered any service from us you have seven days from the day that you place your order in which to cancel. However your right to cancel any service ends when our performance of the service starts even if that is within your cancellation period. In the case of goods returned for refund, payments will be refunded within thirty days of our receiving the goods in good condition. Alternatively, should any goods be unsuitable, we are happy to exchange them or to offer store credit. Should you wish to return any goods for exchange, refund or store credit, you must call or email us in the first instance. We regret that Goods made to your specifications may not be returned unless they are faulty. We are unable to refund gift wrapping charges. All goods should be returned to the following address: -

Shortage or Damage in Transit

You must inspect the Goods at the place and time of delivery and notify us of any shortages, defects in the Goods, or of any other complaint immediately and in any case within ten working days from the date the Goods were delivered, failing which the Goods will be deemed to have been accepted and to be in good working order. Our liability for short delivery is limited to making good the shortage. Where Goods prove to be faulty, we will replace them without charge, or give a full refund within 28 days of the date of the delivery. Where Goods are faulty or not as ordered, we will reimburse the cost of delivery back to us should we ask you to return them to us.

Taxes & Import Duties

All prices are quoted in Pounds Sterling (£) and include where appropriate UK sales tax (Value Added Tax). If your delivery address is outside the European Union, no sales tax will be added to your order. Any import duties or taxes and customs or clearance charges that are payable in the recipient’s country are solely the responsibility of the recipient. They will not be refunded by us should you wish to cancel your order or to return any goods to us for exchange or refund. Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws. Please note that customs may open and inspect packages and that the cost of the goods must be specified on the documentation attached to the package, even if it is a gift.

Force Majeure


The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

Privacy Policy

Archie and Me Ltd (“Archie & Me”) is totally committed to protecting the privacy of our site visitors and customers. The Archie & Me team are customers themselves of other Internet sites and fully appreciate and respect the importance of privacy on the Internet. We will not disclose information about our customers to third parties except where it is part of providing a service to you – e.g. arranging for a product to be sent to you, carrying out credit and other security checks and for the purposes of customer research and profiling or where we have your express permission to do so. We will not sell your name, address, e-mail address, credit card information or personal information to any third party without your permission. If you have made a purchase from Archie & Me you will be added to our mailing list to be updated on our latest products, news and special offers via e-mail, post & telephone. There is the option to opt out at any time.

Cookie Policy

A cookie is a small file which is placed on your computer’s hard drive. Online shops like Archie & Me are allowed to use ‘strictly necessary’ cookies without consent otherwise online shops would not work. They are used to remember, for example, what you put in your shopping basket. If we did not use this then your shopping basket would be empty when you reached the checkout. Cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. Users are advised that if they wish to deny the use and saving of cookies from this website on to their computers hard drive they should take necessary steps within their web browsers security settings to block all cookies from this website and it’s external serving vendors, however this may prevent you from shopping with us.

Changes to Terms & Conditions

The Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase

Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
